1. Privacy Policy (GDPR / CCPA)

Reg. (EU) 2016/679

1.1 Controller. WordRiverCreative, registered at 11100, C. Leon Herrero, 15 P06 A, Cádiz, San Fernando, Spain, is the data controller for personal data processed through this website and our service engagements. Privacy enquiries: [email protected].

1.2 Data we collect. (a) Identity & contact data you submit (name, email, phone, company); (b) project brief content you include in the inquiry console; (c) technical data (IP address, browser type, pages viewed) collected via essential cookies and, with consent, analytics; (d) billing data processed by our payment provider—WordRiverCreative does not store full card numbers.

1.3 Purposes & legal bases. We process data to: respond to inquiries and issue quotes (Art. 6(1)(b) GDPR—pre-contractual steps); deliver contracted copywriting services (Art. 6(1)(b)); maintain accounting and tax records (Art. 6(1)(c) legal obligation); secure and improve the website (Art. 6(1)(f) legitimate interests / Art. 6(1)(a) consent for non-essential cookies); and send service-related notices (Art. 6(1)(b) or (f)).

1.4 Retention. Inquiry data is retained for up to 24 months from last contact. Contract and invoice records are retained for the statutory period required under Spanish commercial and tax law (generally up to 6 years). Project files are retained for 36 months after delivery unless a longer period is agreed.

1.5 Recipients & transfers. Data is shared only with processors acting on our instructions (hosting, email delivery, payment processing, analytics where consented) under data-processing agreements. Where data is transferred outside the EEA, we rely on Standard Contractual Clauses or an adequacy decision.

1.6 Your rights. Under GDPR you may request access, rectification, erasure, restriction of processing, data portability, and object to processing based on legitimate interests. Where processing rests on consent, you may withdraw it at any time without affecting prior lawfulness. You may lodge a complaint with the Spanish Data Protection Agency (AEPD) or your local supervisory authority.

1.7 CCPA notice (California residents). We do not sell or share personal information as those terms are defined under the CCPA/CPRA. You may request disclosure, deletion, and correction of your personal information, and may designate an authorised agent, by contacting [email protected]. We will not discriminate against you for exercising these rights.

1.8 Security. We apply TLS encryption in transit, access controls, and pseudonymised internal records appropriate to the risk. No method of transmission or storage is perfectly secure; we review safeguards on a recurring basis.

2. Terms of Service

Commercial Engagement

2.1 Parties. These terms govern engagements between the Client and WordRiverCreative, 11100, C. Leon Herrero, 15 P06 A, Cádiz, San Fernando, Spain (contact: [email protected]).

2.2 Scope & quotes. Each engagement is defined by a written quote or statement of work identifying deliverables, fixed price, turnaround, and revision allowance. Work begins upon written acceptance and, where applicable, receipt of payment or deposit.

2.3 Fees & payment. Prices are quoted in USD unless stated otherwise. Fixed-price slabs are payable per the invoice schedule in the quote (full upfront or 50/50 split). Retainers are billed monthly in advance. Late amounts accrue statutory interest plus reasonable collection costs. Payment links are provided via our third-party processor; that processor's terms apply to the payment transaction itself.

2.4 Revisions. Fixed-price services include two (2) rounds of revisions on the core deliverable, requested within fourteen (14) calendar days of each draft delivery. Revisions outside the agreed scope, rush changes, or additional rounds are quoted separately.

2.5 Client responsibilities. The Client will provide accurate brand assets, product information, access credentials where required, and timely feedback. Delays in feedback or materials extend the turnaround day-for-day. The Client warrants that materials supplied to us are lawfully usable and do not infringe third-party rights.

2.6 Intellectual property. Upon receipt of full payment, WordRiverCreative assigns to the Client all rights in the client-specific final deliverables, excluding our pre-existing templates, frameworks, methods, and know-how, which remain ours. We may reference the Client's name and publicly available brand marks in a portfolio unless the Client opts out in writing.

2.7 warranties & liability. Deliverables are provided with reasonable professional skill and care. Copy performance depends on factors outside our control (offer, traffic, deliverability, market conditions); we do not guarantee specific revenue or ranking outcomes. To the maximum extent permitted by law, our aggregate liability under any engagement is limited to the fees paid for that engagement. Nothing limits liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law.

2.8 Termination. Either party may terminate for material breach not cured within fourteen (14) days of notice. On termination, the Client pays for work completed to the termination date. Sections on IP, confidentiality, liability, and payment survive termination.

2.9 Governing law. These terms are governed by the laws of Spain, with exclusive jurisdiction in the courts of Cádiz, without prejudice to mandatory consumer protections in the Client's country of residence.

3. Cookie Policy

ePrivacy · Consent

3.1 What cookies are. Cookies and similar technologies are small files stored on your device when you visit this site. They help pages remember state (such as your cookie-banner choice) and, where consented, measure usage.

3.2 Strictly necessary cookies. These enable core functions such as security, network management, and remembering your cookie-consent preference (localStorage / first-party cookie). They cannot be switched off via our banner and do not require consent under the ePrivacy Directive.

3.3 Preference & analytics cookies. With your consent, we may set cookies to understand aggregate page performance and improve content. Non-essential cookies are only set after you accept them in the banner. You can refuse or withdraw consent at any time by clearing site data in your browser—withdrawal does not affect prior lawful processing.

3.4 Third-party content. Embedded content (for example, the Google Maps frame on the contact page) may set its own cookies when loaded. Google's handling of map-related data is governed by Google's policies; the embed is loaded for functional location display. We do not use third-party advertising cookies.

3.5 Managing cookies. Most browsers let you block or delete cookies in settings. Blocking strictly necessary cookies may degrade site functionality (e.g., the consent banner may reappear each visit).

3.6 Contact. Questions about this policy: [email protected], WordRiverCreative, 11100, C. Leon Herrero, 15 P06 A, Cádiz, San Fernando, Spain.

4. Refund Policy

Cancellation & Reimbursement

4.1 Before kickoff. If you cancel a fixed-price engagement before any research or drafting has begun, you receive a full refund of amounts paid, less any non-recoverable third-party charges already incurred on your behalf.

4.2 After kickoff. Once work has started, payment compensates work completed plus any reserved capacity on your sprint slot. We will refund the unused portion of any advance, calculated pro-rata against the work remaining, or—where you prefer—credit the balance toward another service.

4.3 Deliverable acceptance. If a delivered draft materially fails to match the written scope and we cannot cure it within a reasonable revision window after your good-faith feedback, you may terminate for that deliverable and receive a refund of the fees attributable to the uncured portion, at our discretion proportionate to value delivered.

4.4 Retainers. Monthly retainers are billed in advance and are non-refundable for the current month once the sprint has opened. You may cancel future renewal with written notice before the next billing date; service continues until the end of the paid period.

4.5 How to request a refund. Email [email protected] from your account email with the subject “Refund request,” your invoice reference, and a brief description. Approved refunds are issued to the original payment method within ten (10) business days.

4.6 Statutory rights. Nothing in this policy limits any mandatory cancellation or refund rights you hold as a consumer under applicable EU or Spanish law.
